Terms & Conditions


1. Scope of Services
These Terms and Conditions apply to all personal training sessions, coaching, and fitness-related services provided by Nik Focht – Funxion (hereinafter “the Trainer”). By booking a session or signing a contract, the Client agrees to these terms.

2. Health and Physical Readiness
The Client confirms that they are in good physical health and have no known medical conditions that would prevent them from participating in physical exercise.
The Client is encouraged to undergo a medical examination before starting a new training program.
Medical Disclosure: The Client must inform the Trainer of any physical limitations, injuries, or health changes (including pregnancy) before each session.

3. Cancellation Policy (The “24-Hour Rule”)
Appointments must be canceled or rescheduled at least 24 hours in advance.
Cancellations made less than 24 hours before the scheduled session, or “no-shows,” will be charged at the full rate.
If the Trainer must cancel a session, it will be rescheduled at the earliest convenience or credited to the Client.

4. Payment Terms
Services must be paid for in advance (e.g., for 10-session packages) or immediately upon receipt of an invoice.
Payments are accepted via [Bank Transfer / Twint / Cash].
Training packages are non-refundable and have a validity period of 6 months from the date of purchase.

5. Liability and Insurance
Training is undertaken at the Client’s own risk.
The Trainer is only liable for damages resulting from gross negligence or intent. Liability for slight negligence is excluded to the extent permitted by Swiss law.
Insurance: It is the Client’s responsibility to maintain adequate personal accident and health insurance. The Trainer is not responsible for the loss or theft of personal belongings during training sessions, but will advise on best safety practices.

6. Data Protection
Personal data collected during training (fitness goals, weight, health status) is handled strictly in accordance with the Swiss Federal Act on Data Protection and will not be shared with third parties without consent.

7. Legal Venue
These terms are governed by Swiss Law. The place of jurisdiction is Zürich, Switzerland.
