Privacy Policy
1. Introduction
The protection of your privacy and the responsible handling of your personal data are of central importance to me. As a fitness trainer and operator of this website, I strictly adhere to the Swiss Federal Act on Data Protection (nFADP) and other applicable data protection regulations. This Privacy Policy informs you how I collect and process personal data when you visit my website.
2. Controller
The person responsible for data processing on this website is:
Nik Focht – Funxion
Toblerstrasse 78
8044 Zürich
Switzerland
Email: nik@funxion.ch
3. Hosting and Server Log Files
This website is hosted on servers located in Germany. When you access my website, the hosting provider automatically stores information in “Server Log Files.” This includes:
– IP address of the requesting device
– Date and time of access
– Name and URL of the retrieved file
– Referrer URL (the page you visited previously)
– Browser type and operating system used
This data is technically necessary to ensure the stability and security of the website. Since Germany is recognized by the Swiss Federal Council as providing an adequate level of data protection, your data remains secure within the EU/EEA.
4. Data Collection and Processing Tools
I only collect personal data that you provide voluntarily. To ensure maximum data sovereignty, I use self-hosted solutions that store data directly on the web server.
a) Contact Form (Fluent Forms)
When you contact me via the integrated contact form, the data you enter (such as Name, Email, Phone, Subject, and Message) is processed using Fluent Forms. This data is stored directly on my web server in Germany. It is used solely to process your inquiry and for follow-up questions. No data is transmitted to the plugin developer or other third-party form providers.
b) Newsletter and Email Marketing (FluentCRM)
If you subscribe to my newsletter, I collect your email address (and name, if provided) to send you updates about my services and offers.
Self-Hosted: I use FluentCRM for newsletter management. Unlike many other services, FluentCRM is a self-hosted solution. Your data stays on my web server and is not shared with or stored by external email marketing platforms.
Double Opt-In: I use a Double Opt-In process to ensure you actually own the email address provided.
Unsubscribe: You can revoke your consent at any time via the “Unsubscribe” link at the bottom of every email or by contacting me directly.
5. Data Backups and Disaster Recovery
To ensure the availability and security of your data, I perform regular backups of this website (including the database and all files).
Backup Tool: I use the UpdraftPlus plugin. This plugin acts as a technical interface to facilitate the transfer of backup files. No data is stored by the plugin developer itself.
Storage Location: Backups are stored on Google Drive, a service provided by Google LLC (USA).
Purpose: The processing is necessary for the legitimate interest of ensuring data security and the ability to restore the website in the event of a technical failure (Disaster Recovery) in accordance with Art. 32 nFADP.
International Transfer: While your primary data is hosted in Germany, backups are transferred to Google servers. Google LLC is certified under the Swiss-U.S. Data Privacy Framework, which ensures that the Swiss Federal Council recognizes an adequate level of data protection for such transfers.
6. No Cookies, No Tracking
To maximize your privacy, this website is designed to be as “data-lean” as possible:
No Cookies: This website does not use tracking or marketing cookies.
No Analytics: I do not use Google Analytics or similar tracking tools.
7. Data Sharing
Your personal data will not be sold to third parties. Sharing only occurs:
a) If there is a legal obligation.
b) For the fulfillment of a contract.
c) To technical service providers acting as “Data Processors” (such as my hosting provider in Germany and Google for backup storage), with whom I have concluded a Data Processing Agreement (DPA) where required.
8. Data Security
To protect your data against manipulation, loss, or unauthorized access, I use modern technical security measures, including SSL/TLS encryption (recognizable by “https://” in your browser).
9. Your Rights
Under the Swiss Data Protection Act (nFADP), you have the following rights:
Right to Information: You can request to know what data I store about you.
Right to Rectification: You can request the correction of incorrect data.
Right to Deletion: You can request the deletion of your data, provided no legal retention periods (e.g., the 10-year Swiss bookkeeping requirement for financial records) prevent it.
Right to Object: You can object to the processing of your data at any time.
To exercise these rights, please contact me at the email address provided above. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) of Switzerland.
10. Updates to this Privacy Policy
I reserve the right to update this Privacy Policy to reflect changes in legal requirements or my services.
